Terms of Use

In plain language

Stacks is a personal tool for organizing links you save. You own what you save, and it stays on your device. Please don't use the app to break the law or someone else's rights, and please understand that automatic analysis is a convenience, not a guarantee of accuracy.

1. Agreement

These Terms of Use ("Terms") govern your use of the Stacks app for iPhone and iPad and its "Save to Stacks" share extension (together, the "App"), published by Gerard Rodriguez ("we", "us"). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.

Your use of the App is also subject to Apple's App Store Terms of Service.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, in line with the App Store Terms. This licence is for your own use of the App as intended.

You may not sell, rent, sublicense or redistribute the App; attempt to derive its source code, decompile, disassemble or reverse engineer it except where that restriction is prohibited by law; or remove or obscure any proprietary notices.

3. Your content

Everything you put into Stacks — the links you save, your notes, collections, checklists and reminders — is yours. It is stored on your device. We do not receive it, host it, access it or claim any rights over it. We cannot recover it for you, because we never have a copy.

You are responsible for keeping your own backups. Deleting the App deletes its data from your device.

4. Third-party content

Stacks helps you organize links to material published by other people. That material belongs to whoever created it and is governed by the terms and privacy practices of the site it lives on. Saving a link in Stacks does not give you rights over the underlying content, and we do not endorse, verify, control or take responsibility for anything reachable through a link you save.

When Stacks reads a page to retrieve its title and cover image, it does so from your device at your instruction, in the same way a browser does.

6. Automatic analysis is not guaranteed

Stacks categorizes, tags, titles and summarizes your saves automatically — on supported devices using Apple Intelligence, and otherwise using a keyword-based analyzer. These results are generated automatically and may be incomplete, imprecise or simply wrong. They are a convenience for finding things again, and you should not rely on them as a statement of fact, as advice of any kind, or as an accurate description of the linked material. Always check the original source.

7. Availability and changes

We may update, change or discontinue the App or any of its features at any time. Features that depend on Apple Intelligence require a compatible device with that feature enabled, and are not available everywhere or on every device. Features that read a saved page require a working internet connection and depend on that site remaining reachable.

8. No warranty

The App is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that it will preserve your data.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or exemplary damages, or for any loss of data, profits, revenue or goodwill, arising out of or relating to your use of or inability to use the App. To the extent liability cannot be excluded, it is limited to the greater of the amount you paid for the App or ten euros (€10).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

10. Termination

These Terms apply for as long as you use the App. You may end them at any time by deleting the App. We may suspend or terminate your licence if you materially breach these Terms. Sections 3, 4, 8, 9 and 11 survive termination.

11. Governing law

These Terms are governed by the laws of Spain, without regard to its conflict of law rules, and the courts of Spain will have jurisdiction over any dispute — except where mandatory consumer protection law in your country of residence gives you the right to bring proceedings, or requires a different law to apply, in which case that right is unaffected.

12. Changes to these Terms

We may revise these Terms from time to time. The current version will always be at this address with its effective date. Continuing to use the App after a change means you accept the revised Terms.
